Terms of Service

These Terms of Service ("Terms") govern your use of My GapFinder ("the Service"), operated by My GapFinder ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What My GapFinder is

My GapFinder is an AI-assisted exam marking and revision tool for GCSE and A-Level students in the UK. It allows users to upload photographs of handwritten exam answers alongside official mark schemes, and receive AI-generated marking feedback and topic gap analysis.

2. Eligibility and accounts

• Account holders must be 18 or over, or 13–17 with a parent or guardian's consent and under their supervision. Accounts may not be created by or on behalf of children under 13 without a parent or guardian managing the account.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• If you create student access (via PIN) for a child, you confirm you are their parent, legal guardian, or authorised teacher.
• You must provide accurate information when registering. Accounts found to be using false information may be suspended.

3. Acceptable use

You agree not to:

• Upload content that is illegal, harmful, or infringes third-party rights
• Attempt to circumvent any security measures or access another user's data
• Use the Service to mark live or unreleased exam papers in a way that constitutes academic malpractice
• Resell, sublicense, or commercially exploit the Service without written permission
• Use automated tools (bots, scrapers) to access the Service
• Upload anything other than genuine student exam answer content

5. Intellectual property

• Your content — you retain ownership of any exam images and content you upload. By uploading, you grant us a limited licence to process that content solely to provide the Service to you.
• Our content — the My GapFinder platform, branding, and all software are owned by us. Nothing in these Terms grants you any rights in our intellectual property.
• Exam content — official exam papers and mark schemes are the intellectual property of the relevant exam boards (AQA, OCR, Edexcel, etc.). It is your responsibility to ensure you have the right to use any mark schemes you upload.

6. Payment and subscriptions

• Paid plans are charged in advance on a monthly or annual basis.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — we do not offer prorated refunds for partial periods.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.
• Free plan usage is subject to the limits stated on the pricing page.

7. Service availability

We aim to keep My GapFinder available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, security, or operational reasons. We are not liable for any loss caused by Service downtime or unavailability.

8. Termination

We may suspend or terminate your account if you breach these Terms, without prior notice in serious cases. You may delete your account at any time via account settings or by contacting us. On termination, your data will be deleted in accordance with our Privacy Policy.

9. Limitation of liability

To the fullest extent permitted by law, My GapFinder shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of revenue, or academic outcomes. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.

10. Governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
